About Mark: A gifted writer and editor with a gift for cutting excess words and simplifying complex concepts, Mark’s passion is using plain English over “Legalese.” Mark has over forty years of experience as a lawyer and has seen firsthand how better drafting improves customer relations, reduces the risk of disputes, and makes documents more persuasive.
In addition to teaching advanced legal writing at the University of Arkansas School of Law, Mark wrote two mysteries published by a subsidiary of Time-Warner. His first mystery, The Fractal Murders, was a BookSense selection. His non-legal articles have appeared in magazines such as Modern Dad, Camping & RV, and Inside Kung Fu.
Mark’s passion is improving documents by replacing Legalese with plain English. Plain English is writing that is clear, concise, and easily understood by the target audience. Mark now focuses much of his time on helping businesses, organizations, and lawyers improve their documents.
The distinction between litigation and transactional work is often artificial. Litigation arising out of transactions is almost always the result of poor drafting, insufficient investigation, or an incomplete negotiation. Usually the document contained an ambiguity, failed to define a term, contained inconsistent provisions, or failed to address an important issue altogether.
